Ball had previously posted that Moonshot’s Kimi K3 model performance is approaching that of top public models expected in Q1 2026, and recommended that the U.S. government create regulatory uncertainty to deter regulated enterprises from adopting the model.
Sacks opposed this stance, calling the weaponization of regulatory uncertainty as a competitive tool "completely unacceptable," emphasizing that regulatory decisions must be grounded in facts, logic, and evidence—not deliberately manufactured fear and ambiguity. He also warned that such practices would erode the rule of law in the United States and set a dangerous precedent for future power abuses against any entity. Sacks further pointed out that current leading closed-source large model labs have already consolidated into a revenue duopoly, now attempting to leverage governmental influence to suppress open-source competition; he has repeatedly advocated for open-source models in the past, asserting that a company’s true security foundation lies in retaining model-layer choice rather than relying on a single closed-source vendor.
